These terms apply to this website, run by Quiet Giant Games ("QuietGiantGames", "we", "us"). By using the website you agree to them. If you do not agree, please do not use it.
Each game has its own terms, shown inside the game. For Fishdayz they are at fishdays.fun/#terms, with purchase terms at fishdays.fun/#purchases. If a game's terms and these terms differ, the game's terms apply to that game.
1. Who may use the website
Anyone may read this website. Our games are made for players aged 13 and older; players under 18 should have a parent's or guardian's permission to play and to buy anything.
2. Our content and trademarks
Everything on this website and in our games, including the names QuietGiantGames, Quiet Giant Games and Fishdayz, logos, artwork, characters, music, text and code, belongs to Quiet Giant Games or its licensors and is protected by copyright and trademark law. All rights are reserved.
You may view the website and share links to it. You may not copy, reproduce, republish, sell, modify, scrape, frame or create works based on our content, or use our names or logos, without our written permission. Short quotes and screenshots for personal, non-commercial sharing, reviews and news reporting are fine as long as you credit QuietGiantGames and do not suggest we endorse you.
3. What you must not do
- Break any law, or help someone else do so, while using the website or our games.
- Try to break into, overload, probe or disrupt our websites, servers or games, or get around their security, limits or anti-cheat measures.
- Use bots, scrapers or automated tools on the website or in our games.
- Pretend to be QuietGiantGames, our staff, or another person.
- Sell, trade or transfer game accounts, coins, diamonds or items for real money outside our official shop.
4. Purchases
Purchases are made inside each game and are covered by that game's purchase terms. Payments on the web are processed by our payment provider, Stripe; we never see your card number. Purchases made in an app store follow that store's rules and refund policy.
5. Links to other sites
The website may link to other sites (for example app stores). We do not control them and are not responsible for their content or practices.
6. No warranty
The website and our games are provided "as is" and "as available". To the fullest extent the law allows, we make no promises that they will be uninterrupted, error-free or available at any particular time, and we may change or stop any part of them.
7. Limitation of liability
To the fullest extent the law allows, Quiet Giant Games is not liable for indirect, incidental, special or consequential losses, or for lost data, progress or profits, arising from the website or our games. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or US$50 if you paid nothing. Some places do not allow these limits, so they may not all apply to you; nothing here limits rights you have under consumer law that cannot be waived.
8. Indemnity
If you break these terms or the law and that causes a claim against us, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
9. Changes
We may update these terms. The date at the top shows the latest version. Continuing to use the website after a change means you accept it.
10. Law and disputes
These terms are governed by the laws of the United States and of the state in which Quiet Giant Games is established, without regard to conflict-of-law rules. Please contact us first: most problems can be solved by email. If you live in a country whose consumer laws give you the right to bring claims in your local courts, those rights are not affected.
